Terms of Use

Welcome to the website or mobile resources of takeoff.healthcare GmbH (hereinafter collectively or individually referred to as the “Platform”). This Platform is provided to enable users to search for new jobs. No other purposes are intended. The terms “we”, “us”, “our” refer to takeoff.healthcare GmbH, takeoff.physio and its partners. The term “you” refers to the user who visits the platform and/or provides content on this platform.

You accept these General Terms of Use when you first register for the takeoff.healthcare platform. The contractual relationship between you and takeoff.healthcare GmbH is hereinafter referred to as the “Agreement”. You are aware that this does not constitute an employment contract between you and takeoff.healthcare.

1. Use of the platform

As a condition of your use of this Platform, you warrant that:

  1. all information provided by you on the Platform is correct, accurate and complete; Keep the details of your job search correct and complete. You will also let us know as soon as possible if your situation and job requirements change.
  2. Provide employers who are interested in you and contact you with brief feedback as to whether the offer is suitable for you or not.
  3. you inform employers in good time if you are unable to attend an agreed trial day or interview as planned or if you are unable to take up a position after all.
  4. if you have an account with takeoff.healthcare GmbH, you protect your account information and do not make it available to third parties;
  5. you are authorized to enter into this Agreement and you use this Platform in accordance with all of the terms and conditions set forth herein.

Takeoff.healthcare GmbH does not knowingly collect information from anyone under the age of 16. We reserve the right, in our sole discretion, to deny access to this Platform and the Services offered by us to any person at any time and for any reason, including for any violation of this Agreement. If we discover such a breach, we are entitled to irrevocably delete your account.

Users of the Platform will not be charged any fees for using the Platform in accordance with these Terms of Use. However, the Platform contains links to external websites operated and owned by independent service providers or retailers. These third parties may charge a fee for the use of certain content or services provided on the website.

2 Contractual service

Takeoff.healthcare GmbH contractual performance is limited to the provision of the Platform and the recruitment services. Takeoff.healthcare GmbH does not guarantee you success in your job search and assumes no responsibility for the conclusion or non-conclusion of an employment relationship.

Upon successful registration, you will receive a non-exclusive and non-saleable license to use the platform in accordance with the following conditions. The license is limited to the duration of the account use.

The platform is made available to you “as is”, i.e. with all errors and with the functions available in the current version. There is no claim to a minimum availability or freedom from errors of the platform. Takeoff.healthcare GmbH will endeavor to remedy any malfunctions or reported errors within a reasonable period of time.

3 Impermissible activities

The content and information on this platform (including, but not limited to, messages, data, information, text, music, sound, photographs, graphics, videos, maps, icons, software, code or other material) and the infrastructure used to provide such content and information are our property. You agree that you will not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, transfer, sell, resell or otherwise use any information, software programs, products or services obtained from or through this Platform in violation of this Agreement. Furthermore, you agree to refrain from the following in particular:

  1. Use this Platform or its content for business purposes;
  2. monitor or copy any content or information from this Platform or access it by any robot, spider, scraper or other automated means or by any manual process for any purpose without our express written consent;
  3. violate any restrictions contained in the header of this Platform relating to the exclusion of automated scraping programs (“robots”), or circumvent or bypass any other measures intended to prevent or restrict access to this Platform;
  4. Take any action that imposes, or may impose, in our judgment, an unreasonable or disproportionately large load on our infrastructure;
  5. Create deep links to any part of this Platform for any purpose without our express written consent;
  6. frame or mirror any part of this Platform or otherwise integrate it with any other Platform without our prior written consent; or
  7. Attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any software programs used by Takeoff.healthcare GmbH in connection with the Platform or the Services.

4. Data protection

You are aware that the conclusion and fulfillment of this Agreement will result in the processing of your personal data by Takeoff.healthcare GmbH. This includes personal master data, applicant data, your usage behavior on the platform and your experience reports in relation to (interested) employers.

By concluding this agreement, you consent to the transfer of your applicant data to interested employers. We or the employers will only obtain certain references if you have expressly consented to this. We will retain your applicant data in accordance with the statutory provisions, unless you explicitly instruct us to retain it for longer.

By accepting these Terms of Use, you also consent to Takeoff.healthcare GmbH evaluating your usage behavior and the testimonials you share with Takeoff.healthcare GmbH in order to:

  1. improve the services of Takeoff.healthcare GmbH
  2. show you better job offers tailored to you and inform you about selected news or events;
  3. provide employers with anonymized evaluations of your user behavior and experience so that they can increase the attractiveness of their job offers.

5. Deletion of an account

Account holders acknowledge and accept that upon permanent deletion of their account, all personal information, including email addresses, names, applicant data and recorded reviews will be irrevocably deleted.

6. Exclusion of liability

Takeoff.healthcare GmbH excludes its own liability and that of its vicarious agents to the extent permitted by law. This means that Takeoff.healthcare GmbH is only liable to you for direct and willful or grossly negligent breaches of duty in connection with the Platform.

‍

Takeoff.healthcare GmbH is in no way liable for misconduct/breaches of duty by the potential or mediated employers. You must assert all claims arising from or in connection with the mediated employment relationship or job interview with the respective employer.

‍

Takeoff.healthcare GmbH is not liable for any damages you may incur as a result of using the platform in violation of the law or the contract.

7. Indemnification

You agree to indemnify, defend and hold harmless Takeoff.healthcare GmbH and its affiliates and all of their employees and agents from and against any claims, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind, including reasonable attorneys' and administrative fees, asserted by any third party against Takeoff.healthcare GmbH on the following bases:

  1. breaches by you of this Agreement or the documents referenced herein;
  2. any violation by you of any law or the rights of any third party; or
  3. your use of this Platform.

8. Links to third party websites

This Platform may contain hyperlinks to websites operated by parties other than Takeoff.healthcare GmbH. These hyperlinks are provided for your reference only. We have no control over these websites and are not responsible for their content or the privacy or other practices of these websites. You are also responsible for taking appropriate precautions to ensure that any links you select or software you download (whether from this website or any other website) are free of viruses, worms, Trojan horses, defects and other items of a destructive nature. Our inclusion of hyperlinks to these websites does not imply any endorsement of the material on these websites or any association with their operators.

Takeoff.healthcare GmbH is not responsible for content on websites operated by parties other than Takeoff.healthcare GmbH.

9. Copyrights

You grant Takeoff.healthcare GmbH an irrevocable, royalty-free, perpetual, exclusive, worldwide license to use, copy, reproduce, publish, perform, sell, display, distribute or otherwise exploit (in whole or in part) your employer reviews and testimonials.

You may not copy, use, reproduce, publish, perform, display or distribute any content to which Takeoff.healthcare GmbH has any intellectual property or other rights without prior written permission.

‍

10 Changes

Takeoff.healthcare GmbH may, in its sole discretion, modify, add or delete portions of these Terms of Use from time to time as Takeoff.healthcare GmbH deems necessary.

‍

Takeoff.healthcare GmbH may change, limit, suspend or discontinue any aspect of the Takeoff.healthcare GmbH Service, including the availability of any feature, database or content, at any time. No notice is required and no liability will arise.

‍

In the event of a change to these terms of use, we will inform you in text form. By continuing to use our service, you agree to the changes. If you do not agree to a change, you must contact us so that we can delete your account and, if necessary, your data.

11. Final provisions

Our performance of this Agreement shall be governed by Swiss law, excluding its conflict of law rules. The exclusive place of jurisdiction for all disputes between Takeoff.healthcare GmbH and you is - subject to any partially mandatory or mandatory places of jurisdiction - Luzern.

‍

Should one or more provisions of this agreement be void or invalid, this shall not affect the validity of the remaining provisions. In this case, the invalid or ineffective provision(s) shall be replaced by legally valid provisions that are as close as possible to the economic purpose of the invalid or ineffective provision(s).

‍

This Agreement and any other terms of use referenced herein constitute the entire agreement between you and Takeoff.healthcare GmbH with respect to this Platform and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the Client and Takeoff.healthcare GmbH with respect to this Platform.
